Applicability of TDS

Tax Deducted at Source (TDS) applicability depends on the nature of the transaction. As per the Income Tax Act, TDS is generally applicable on service-related components, while it is not applicable on license. In our case, services such as technical support attract TDS, whereas Google Workspace License, domain registration, hosting, SSL, and DNS are not subject to TDS.
Customers are advised to evaluate TDS applicability carefully and deduct tax only on the relevant service portion, wherever applicable, instead of the entire invoice value.

Here are the few questions realted to TDS Applicability

TDS is applicable on service-related components, such as technical support services.

TDS is not applicable on license fees and standard products/services such as Google Workspace, domain registration, hosting, SSL, and DNS.

TDS is applicable at 2% under Section 194J for technical support services.

No, TDS should be deducted only on the service portion and not on the entire invoice.

If an invoice includes both license fees and support services, TDS should be applied only to the technical support portion.

License fees are treated as standard products or subscriptions rather than services, and therefore TDS is generally not applicable.
